These terms of sale apply to purchases made from the online shop at cruffin.ee.<\/p>\n
The owner and seller of the online shop is Saiatehas O\u00dc<\/strong> (registry code 16158989, VAT no. EE102340370), located at Kastani 42, 50410 Tartu, Estonia, e-mail sai@cruffin.ee.<\/p>\n These terms of sale apply to contracts of sale concluded through the online shop between the buyer (the customer<\/em>) and Saiatehas O\u00dc, referred to below as Cruffin<\/em>.<\/p>\n In addition to these terms, purchases from the online shop are governed by the laws of the Republic of Estonia, in particular the Law of Obligations Act and the Consumer Protection Act.<\/p>\n Cruffin may amend these terms of sale. Amendments take effect when published in the online shop and do not apply retroactively to orders already placed. The terms that applied at the moment an order was submitted govern that order.<\/p>\n The online shop sells fresh bakery and pastry products, drinks, gifts and gift cards.<\/p>\n All prices are in euros and include VAT. The price shown with a product applies at the moment the order is placed.<\/p>\n Product photographs are illustrative. The appearance, weight and shape of handmade products vary slightly from batch to batch \u2014 this is not a defect.<\/p>\n The product range depends on the location.<\/strong> Each product states the Cruffin location where it is available. If your basket contains products that are not sold at the location you want, that location cannot be selected for collection.<\/p>\n Cruffin reserves the right to change its product range and prices.<\/p>\n Allergen information is provided with every product. If you have a food allergy or intolerance, please read the product information before ordering and write to sai@cruffin.ee if anything is unclear.<\/p>\n Our products are made in a kitchen that handles gluten, milk, eggs, nuts and sesame. We cannot rule out cross-contamination with these allergens in any of our products<\/strong> \u2014 we do not offer gluten-free products.<\/p>\n Our products are fresh and contain no preservatives. They are intended to be eaten on the day of collection unless stated otherwise on the product.<\/p>\n To place an order, add the products you want to your basket, choose the collection location and time, fill in the required fields and pay for the order.<\/p>\n Before you confirm the order you are shown a summary: the products, quantities, collection location and time, and the final amount. By confirming the order you make a binding offer to purchase.<\/p>\n The contract is concluded once the order has been paid for<\/strong>, when the payment has been received in the bank account of Saiatehas O\u00dc. Where payment is made against an invoice (see clause 5.2), the contract is concluded when Cruffin confirms the order. Order confirmation is sent to the e-mail address you entered when placing the order.<\/p>\n Because the contract is concluded by means of distance communication (a website), it is a distance contract within the meaning of \u00a7 52 of the Law of Obligations Act, including where you collect the order yourself.<\/p>\n Please check that the details you enter are correct. If the e-mail address or telephone number is wrong, the order confirmation and other notices may not reach you.<\/p>\n Cruffin may cancel an order and refund the payment if a product unexpectedly becomes unavailable (for example a shortage of ingredients or an equipment failure), or if the order contains an obvious error such as a clearly incorrect price. We will contact you if this happens.<\/p>\n Orders are paid for in advance in the online shop. Payments are processed by Montonio<\/strong>. You can choose:<\/p>\n Payment takes place in Montonio's secure environment. Cruffin does not see or store your banking credentials or card details.<\/strong> Montonio's own terms of service also apply at the moment of payment.<\/p>\n An order is taken into production once payment has been received. If payment is not received, the order is not fulfilled.<\/p>\n Legal persons may pay against an invoice. To arrange this, contact sai@cruffin.ee before placing your order and state the company name, registry code, address and the e-mail address of the invoice recipient.<\/p>\n The payment term for an invoice is 7 days from the date it is issued. The order is handed over at the agreed time, including before the invoice has been paid.<\/p>\n In the event of late payment, Cruffin may charge interest of 0.05% per day on the outstanding amount and suspend acceptance of further orders until the debt has been settled.<\/p>\n Payment against an invoice is not a service directed at consumers \u2014 the right of withdrawal described in clause 9 applies only to consumers within the meaning of \u00a7 1 of the Law of Obligations Act.<\/p>\n Orders are collected from the chosen Cruffin location:<\/p>\n Orders must be placed at least 24 hours before the desired collection time.<\/strong> We cannot accept orders through the online shop at shorter notice, because the products are baked in the early morning.<\/p>\n When you collect your order, give your name or the order number to the member of staff.<\/p>\n Because of the nature of fresh goods, please collect your order on the agreed day.<\/strong> If an order is not collected by closing time at that location on the chosen day, the order is deemed to have been handed over; the product is not kept or replaced, and no refund is given, because these are perishable goods that Cruffin has made for the customer.<\/p>\n If you cannot collect your order, let us know as soon as possible at sai@cruffin.ee. We will find a solution.<\/p>\n Cruffin does not deliver online shop orders itself.<\/p>\n A gift card is a bearer instrument: anyone holding the card can use it. A lost or stolen gift card is not replaced or blocked.<\/p>\n Gift cards can be used on the premises only<\/strong> at Cruffin's shops at Kastani 42 and Raekoja plats 6. Gift cards cannot be used to pay in the online shop.<\/p>\n A gift card must be used in a single purchase.<\/strong> The gift card is a paper card on which no remaining balance can be recorded, and it is therefore treated as used on first use. If the purchase costs less than the value of the gift card, the unused balance is not refunded in cash and is not transferred to a new card. If the purchase costs more, the difference is paid in the usual way.<\/p>\n A gift card is valid for one year from the date of purchase.<\/strong> After it expires the gift card is no longer valid and no refund is given for it.<\/p>\n Gift cards are not refunded in money and are not exchanged for cash.<\/p>\n Under \u00a7 53(4) of the Law of Obligations Act<\/strong> a consumer has no right to withdraw from a distance contract where the object of the contract is goods that deteriorate or expire rapidly, or goods made to the consumer's personal requirements.<\/p>\n Cruffin's bakery and pastry products and drinks are fresh, perishable goods made for each individual order. The 14-day right of withdrawal does not apply to them.<\/strong><\/p>\n This does not affect your right to file a complaint about a defective product (see clause 10).<\/p>\n Products that are not food \u2014 for example the tote bag and the stickers \u2014 are subject to a consumer's 14-day right of withdrawal<\/strong>.
